Housing and the TAL

Response to a notice of lease modification (rent increase)

You have one month to refuse an increase; otherwise it is deemed accepted. A compliant response, signed by a lawyer.

Time limit to respond
“within one month after receiving the notice of modification”
C.c.Q., art. 1945
Without a response
The tenant “is deemed to have agreed to renew the lease on the conditions proposed by the lessor”
C.c.Q., art. 1945

What is included

  • Review of the notice you received (form, time limit, content)
  • Letter refusing the modification or notice that you are leaving, depending on your choice, reviewed by the lawyer
  • Explanation of what comes next: the landlord has one month to apply to the TAL (art. 1947)

What is not included

  • Representation at the rent-fixing hearing
  • Calculation of the increase using the TAL's grid (you can use the TAL's official tool)

What might be added

  • If the landlord files an application to fix the rent, a consultation (CA$169) or preparation for your hearing may be useful.

Any additional service is announced at a fixed price, in writing, before it is undertaken.

  1. 1

You upload the notice you received and give the date you received it.

  2. 2

We draft the refusal (or the notice that you are leaving); the lawyer reviews it.

  3. 3

You send it to the landlord with proof of receipt before the deadline we calculate for you.

You follow each step in your client area. The LIORMA team prepares; the lawyer advises, validates and signs. No decision concerning you is made without human review.

What the law says

Excerpts of the law are reproduced in their official French version; the explanation that follows is translated.

C.c.Q., art. 1945
« dans le mois de la réception de l'avis de modification du bail »

The tenant must refuse in writing within that time limit; otherwise the increase applies.
