What is included

  • Check of the legal conditions (more than three weeks late, art. 1971 C.C.Q.)
  • Drafting and filing of the application for lease termination and eviction, with recovery of the rent owed
  • TAL filing fee (CA$92) included
  • Preparation of the evidence (lease, payment record, notices)
  • Representation at the hearing by the lawyer or an authorized representative (Act respecting the Administrative Housing Tribunal (LTAL), ss. 72 and 74)
  • Follow-up until the decision and explanation of enforcement

What is not included

  • Bailiff fees for serving the application or enforcing the decision (billed at the bailiff's actual cost)
  • Application for revocation, or appeal
  • Pure recovery of rent without termination (not permitted for a lawyer when the amount falls within small claims limits, LTAL, s. 73)

What might be added

  • If the tenant pays before the judgment, the TAL may refuse the termination; the application then stands for the rent owed. A second hearing (postponement requested by the other party) is included; beyond that, CA$299 per additional hearing.

Any additional service is announced at a fixed price, in writing, before it is undertaken.

  1. 1

You answer the eligibility questions and upload the lease and the payment history.

  2. 2

We draft the application; the lawyer validates it and files it with the TAL.

  3. 3

We prepare the hearing and represent you; you receive the decision and the next steps.

You follow each step in your client area. The LIORMA team prepares; the lawyer advises, validates and signs. No decision concerning you is made without human review.

What the law says

Excerpts of the law are reproduced in their official French version; the explanation that follows is translated.

C.c.Q., art. 1971

The landlord may obtain termination of the lease if the tenant is more than three weeks late in paying the rent, or if the landlord suffers serious prejudice because of frequent late payments.

Loi sur le Tribunal administratif du logement, art. 73
« un avocat ne peut agir si la demande a pour seul objet le recouvrement d'une créance qui n'excède pas la compétence de la Cour du Québec en matière de recouvrement des petites créances »

That is why this product is always an application for termination and eviction, with recovery of rent as an accessory claim.

Frequently asked questions

How long before the eviction?+

The TAL reports an average of 2.1 months before the first hearing for non-payment (2024-2025 report). After the decision, enforcement by a bailiff takes a few more weeks.

What if the tenant pays in the meantime?+

The tenant can avoid termination by paying the rent owed, interest and costs before the judgment. You then recover your rent; TAL fees are usually awarded to the landlord.
